BUSiCALL Terms of Service and Purchase
This is a contract agreement: Clicking on Purchase means you agree to the contract terms of Service
Effective as of August 10, 2011
Please review these Terms of Sale carefully as they govern your purchases at http://www.whitetelco.com (including http://kuggaa.com) (the “Website”). These terms describe your rights and obligations with respect to your purchases, including important limitations and exclusions product warranties. Further, if your purchase on the Website includes any Busicall or Kuggaa Mobile product, these Terms of Sale reiterate your obligations under theTerms of Use regarding money back guarantee. Your placement of an order at http://www.whitetelco.com (including http://Kuggaa.com) constitutes your agreement that these Terms of Sale apply to the order, so be certain you understand them before you place your order. If you purchased the product through a third party and the product was delivered with license key to you or the third party, the guarantee of money back for any reason is still governed by this agreement. Meaning, acceptance of this license key by owner or third party whom purchased the product for the owner constitutes a contractual agreement governed by these terms of use.
1. You may not transfer any license to any other party during the 15 month license.
2. The first 90 days of the license is no guarantee of traffic to web site, hits, links, emails for product requests, phone calls, or walk in visitors shall exist.
3. The first 90 days the license is during the activation period. During activation period the process of exclusive data base insert and conditioning shall be done.
4. Any business related to Busicall during the activation period as seen in our report “Call Detail Report” does not constitute the end of the 90 days insertion period.
5. After the 90 day insertion period; we may extend the activation period and extend the license period free of charge based upon challenges found with competitors in your business radius or zip codes.
6. The license begins upon the end of the 90 period and as long as the customer is not notified by email of an extension of the activation period.
7. Upon the end of the activation period, 3 months of the 15 month license period are subtracted from the total business license time.
8. After activation period, 12 months remains on the license and is termed the activated period.
9. During the activated period customers shall experience no less than 100 customer contacts by means of phone calls, emails, web hits, direction requests per month.
10. Noncompliance by our licensed software as a service shall be remedied by the following means:
a. Extension 1 month of license for each non-compliant month.
b. Re-activation period and license start over at the 15 month.
c. Full refund at the 15 month expire mark.
d. Under no means shall a customer charge back a credit card at any time while the service license is operational. Such a charge back shall constitute $ 999.99 penalty for fraudulent theft of services and acceptance of this terms of service will allow billing of the amount to the credit card, checking account, or invoice for collections.
11. Refund request are handled by email to sales {at} Kuggaa.com. Give the purchase information and reason for refund. If you meet the following terms a refund may or may not be granted:
a. Less than 100 calls, web hits, emails, and or direction request 3 months in a row; excluding activation period.
b. The period of the license has expired at 15 months and was not renewed.
c. The web hits, calls, direction request and license have been resold to a competitor.
12. All refunds are sent out via certified mail with certified funds made out to the Purchasing party company name the service was bought under.
